Biocidal regulation update

REGULATION (EU) No 528/2012 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 22 May 2012 concerning the making available on the market and use of biocidal products (BPR) repealed the old EC 98/8 Directive that for the first time regulated the complex market of biocidal products and active substances. BPR entered into force on September 1, 2013…….almost 5 years ago.

The main focus of the BPR was the introduction, among many others, of some important news:

  • Art 95 listing of active substance manufacturers/providers. This means that a provider (manufacturer/importer) of a given active substance must be listed in Art. 95 list to be authorized to provide such an active. Art. 95 list includes the company name, the active substance and the biocidal Product Type (PT) related to the such provision.
  • Family approach replaces the old approach of the frame formulation. A family of similar biocidal products can be built up following certain criteria such as: their common safety classification, their common physical form and formulation, a similar efficacy profile.
